The court found the BBC had been validly terminated on 11.6.2025 for multiple events of default so the Plaintiffs had no proprietary or possessory entitlement to the ship at the time the writ was issued; Plaintiffs failed to disclose that material fact when obtaining the arrest warrant (breaching Order 70 r4(6)(b)); accordingly admiralty jurisdiction was not properly invoked and the in rem writ and arrest were set aside; the arrest was mala fides or grossly negligent and damages for wrongful arrest shall be assessed; owner entitled to default judgment for possession and control of the vessel.
