The court found special and exceptional circumstances: surrendering 11 buses would render the appeal nugatory and cause irreparable harm including loss of business permits and licences and irreplaceable commercial loss; the Defendant's financial ability to compensate did not negate the irreparable nature of the harm. On that basis the court exercised its discretion to grant a stay of execution and awarded costs of RM2000 to the Defendant.
