Clause 3 devises the whole of the testator's Malaysian estate to the trustee and, by operation of Wills Act s18, the property in dispute formed part of the testator's estate at death; combined with the express exclusion of certain heirs in clause 4, the will effected a complete testamentary disposition so no partial intestacy arose and the disputed property vests in the trustee to be distributed according to the will.
