The petition challenged sections 63 and 64 under Articles 5 and 8 which constitutes an inconsistency challenge not an incompetency challenge under Article 4(3); the Federal Court therefore lacked the exclusive original jurisdiction to entertain the petition, the prior leave was improperly granted and, exercising its inherent powers (and Rule 137), the Court set aside the leave and struck out the petition.
