Plaintiff failed to prove on the balance of probabilities that the defendants or the named third parties caused the alleged deliberate damage; the Due Diligence Report and the witness/expert lacked the necessary scientific proof and personal knowledge to establish causation and quantum; furthermore the Sale and Purchase Agreement contained an clear “as is where is” term and the purchaser completed payment with knowledge of the report, constituting waiver of the right to rescind or claim damages — therefore no liability arises and the lower court’s dismissal is upheld.
