Appellant failed to comply with mandatory rr 4 and 5 of the 1994 Rules; the 1994 Rules contain no express power to abridge prescribed times so the Court may not use ROC provisions to extend them; the application to extend time was inordinate, unexplained and would prejudice the respondent and intervener; accordingly the application was dismissed and the substantive appeal held incompetent and dismissed with costs.
