On the balance of probabilities the ATP and DOT were sham instruments concealing illegal moneylending; they are therefore unlawful and void under the Moneylenders Act 1951, the Plaintiff relied on an illegal transaction and failed to discharge the burden of proof, and accordingly the Plaintiff's claim is dismissed with costs.
