The High Court upheld the Sessions Court convictions because the prosecution proved the urine test under s31A and the s37(k) presumption was not rebutted, and previous convictions were properly proved by certified Registrar records under RCIUPA s10 read with CPC s400; Parliament's s39C contains no temporal restriction so prior convictions, even if older, may be relied upon; however appellate discretion warranted reducing the custodial sentence from 7 to 6 years while maintaining post-release AADK supervision and sparing corporal punishment due to age.
