Vernacular/national-type schools are not "public authorities" within art.160(2) and therefore use of Tamil and Chinese as media of instruction in such schools is not an "official purpose" prohibited by art.152(6); furthermore art.152(1)(b) preserves and sustains languages used immediately prior to Merdeka, so ss.2,17,28 of the Education Act 1996 are not unconstitutional; Order 14A was appropriate to decide the pure questions of law; consequently the substantive appeals fail.

The Civil High Court lacks jurisdiction to review or set aside decisions of the Syariah High Court and Syariah Court of Appeal in respect of matters within Syariah jurisdiction (here, division of matrimonial assets), and the Syariah courts' orders in the present context do not amount to decisions of a public authority amenable to judicial review under Order 53; accordingly the judicial review application is dismissed with costs.

SRJKC and SRJKT established and maintained under the Education Act 1996 perform statutory public functions and thus qualify as public authorities, but Article 152 interpreted in its historical context protects the use and preservation of other mother tongues in the national education system; accordingly Sections 17 and 28 of the Education Act 1996 are not ultra vires Article 152(1) and the plaintiff's originating summons is dismissed.
