The court found Statements 1 and 6 to be defamatory of the five claimants and that the defendant failed to establish justification, fair comment or qualified privilege for those statements because they were unsubstantiated, false in material respects and published recklessly; conversely Statements 8 and 9 were not defamatory and were protected as fair comment. Damages of RM50,000 were awarded to each claimant and costs awarded to plaintiffs for Suit 71; claims by the defendant in the related suits were dismissed.
