The High Court held that the s.84 CJA and Article 128 FC thresholds were satisfied because the referral question arose directly from the proceedings, concerned the validity of a State law vis-à-vis federal constitutional rights (Article 10(1)(c)) and other provisions, and a Federal Court determination was necessary for finality; accordingly the application to refer the constitutional question to the Federal Court was allowed.
