SP3 was not shown to have been appointed as an officer under s3 of Act 7 and therefore lacked statutory competence to confirm and tender registrable particulars; Exhibits P.8 and P.9 A-B were inadmissible; absent admissible proof of two prior s15(1)(a) convictions the enhanced penalty under s39C(1) could not be imposed, so the trial court's s39C sentence was set aside and substituted with a lawful s15(1)(a) sentence (fine RM3000 in default five months imprisonment and two years police supervision).
