The affidavit by the next of kin was valid under section 367 CPC due to restraint; the High Court retains jurisdiction to examine legality of past detention even if applicants were released, but the determination of damages and disputed factual issues of false imprisonment belong to civil proceedings; accordingly the habeas corpus application and the prayer for damages are dismissed and applicants may pursue civil action.
