The affidavit by the next of kin was valid under section 367 CPC due to restraint; the High Court retains jurisdiction to examine legality of past detention even if applicants were released, but the determination of damages and disputed factual issues of false imprisonment belong to civil proceedings; accordingly the habeas corpus application and the prayer for damages are dismissed and applicants may pursue civil action.

On the evidence the plaintiff proved on the balance of probabilities that both the initial arrest (18.9.2015) and the subsequent detention under SOSMA (23.9.2015–18.11.2015) were unlawful because defendants failed to show reasonable complaint, credible information or reasonable suspicion and failed to justify SOSMA detention; however the plaintiff failed to prove malice required for malicious prosecution, therefore that claim was dismissed; damages of RM300,000 and costs RM50,000 awarded with 5% p.a. interest on judgment sum.

The appeal is dismissed. The habeas corpus application directed at the s.4(1)(a) remand was academic because that order had lapsed and custody was then governed by a valid s.4(2)(a) remand; there was no procedural non-compliance in either s.4(1)(a) or s.4(2)(a) detentions; section 4 POCA is constitutional and within Parliament’s powers under the Federal Constitution; the Minister’s inclusion of unlawful gaming in the POCA schedule was within delegated powers and consistent with POCA’s purpose; allegations of mala fides were not established.

Section 4 of the Prevention of Crime Act 1959 is void to the extent that it mandates fixed remand periods once procedural prerequisites are satisfied because it removes judicial discretion and unlawfully fetters judicial power in breach of Article 121(1) read with Article 4(1); detentions under Act 297 for gambling syndicates are inconsistent with Article 149(1)(a); consequently the appellants are entitled to writs of habeas corpus and immediate release.

The Court held the arrest and detention of the 1st Plaintiff were unlawful because the FIR did not disclose an offence under s.13 ATIPSOM against her, she was a legal worker with valid permits, there was no reasonable suspicion or credible information to justify her arrest or extended remand and the remand applications lacked requisite justification; accordingly the High Court order holding liability and awarding damages is upheld in part, para (b) set aside and Appeal No.108 allowed while Appeal No.748 was dismissed.

The High Court allowed the preliminary objection and dismissed the habeas corpus applications as academic because the remand orders challenged had been superseded by detention orders under section 19A(1) issued by the Prevention of Crime Board (a different authority than the respondents named), rendering any writ directed at the earlier remand ineffective; additionally the court held POCA applies to non-citizens based on the Act's long title, preamble and the term 'person' in section 3(1).
