Plaintiffs failed to plead and prove a cause of action and failed to establish that SD2 made a binding representation, that they relied on it, or that estoppel or legitimate expectation applied; consequently no breach was proved and claims for special and general damages are dismissed.

The court found the pleadings and evidentiary documents disclose a reasonable cause of action: defendant 2 signed a guarantee, insurer correspondence and invoices show amounts paid and remaining balances, and disputed representations about an estimated RM45,000 require oral evidence; therefore the matter is not plainly or obviously unsustainable and the strike-out application must be dismissed.

The High Court held that the three Confirmation of Balance letters constituted sufficient admissions that RM145,000 was due to the applicants, the defendant failed to adduce any updated audit or other evidence to rebut those admissions and there were no triable issues or res judicata bar sufficient to defeat the summary judgment; appeal dismissed.

The court accepted the defendant's preliminary objection based on locus standi and conflict of interest following Soo Teck Lee; it held that members of Tetuan Lim, Ho, Cheong & Lok could not continue to act for the plaintiffs and ordered the firm removed from representation, stayed the hearing and decision on kandungan 8 under A.92 k.4 KKM 2012 until plaintiffs appoint new solicitors within two weeks, with no order as to costs.
