The Court found the petitioner and his solicitor intentionally concealed that the Suit 660 judgment was payable to Masera not the petitioner, that OKK lacked authority to act for Masera, and that the petition and the resulting winding up order were procured by fraud and constituted an abuse of process; accordingly the Court exercised its inherent jurisdiction and s493 Companies Act 2016 to terminate and set aside the winding up order and awarded costs to the Applicant.
