On the balance of probabilities the Plaintiff failed to prove the funds were advanced to Globetel; the Plaintiff's signature on the 6.4.2015 covering letter acknowledging receipt of signed resignation and transfer documents was genuine as established by expert comparison and specimens; the Defendant thus performed the LOU condition by delivering the relevant documents and the LOU operated as accord and satisfaction/waiver extinguishing the claim; interlocutory dismissal of summary judgment in prior Suit 693 did not operate as res judicata.
