The court exercised its discretion under s.145 NLC to terminate the co-ownership and order partition according to the defendants' proposed plan because the plaintiffs' plan was prejudicial to a long-standing occupier (Defendant 11) whose right to residence and enjoyment under s.343(1)(b) and constitutional protections would be violated; the defendants' plan preserved existing structures, access and the status quo and was therefore just and equitable.
