Because the Director General of Insolvency found no offence and there was no record that the judgment debtor had been charged or convicted for any bankruptcy offence, s33(4) and s33(6) did not apply; therefore the court exercised its discretion under s33(3), taking into account age, health, duration of bankruptcy, conduct and DGI findings, and granted an unconditional discharge.
