Appellant accepted and admitted receipt of the RM100,000 into the firm's client account for the stated purpose of purchasing insurance, thereby creating a retainer and fiduciary duties; his failure to ensure payment to the insurer and to obtain proof amounted to gross negligence and misconduct under s94(3)(n) and (o) LPA; the Disciplinary Committee and Disciplinary Board findings on liability were not perverse or in breach of natural justice and the Board's sanction was within its disciplinary discretion, so the appeal is dismissed.
