The application was dismissed because the applicant failed to satisfy the cumulative tests for admission of fresh evidence: the asserted new evidence was either already raised at trial or not shown to be credible or sufficiently relevant, there was unjustified delay and an appearance of afterthought, and the trial judge had found the prosecution witnesses credible and that the existing evidence sufficed to convict; therefore admission would not have produced reasonable doubt.
