The Court held that the respondent performed acts at the core of legal practice (advising on merits, drafting/vetting documents, recommending and appointing solicitors and counsel) for contingent reward and thus acted as an unauthorized person in breach of S.37 and S.40 LPA; the arrangement constituted touting and was void for public policy under Section 24 Contracts Act 1950; accordingly the appeal is allowed, the High Court decision is set aside, and specified consequential orders were made directing payment of the disputed funds to the intervener and setting aside prior cost orders.
