Plaintiff established a prima facie case of continuous non-use during the relevant three-year period by an admissible private investigation report; Defendant failed to rebut with credible contemporaneous evidence of lawful commercial use within the relevant period, and alleged invoices were insufficient and likely unlawful because Defendant did not have a registered business name, therefore there was no use in good faith/in the course of trade and the registered mark must be expunged under s.46(1)(b) TMA 1976.
