The ex parte order is set aside because the applicants failed to make full and frank disclosure and breached natural justice, did not comply with the procedural notice requirements of s.96(3) RTA, and the declaratory relief was being used in a manner likely to defeat foreign proceedings; accordingly the ex parte order was irregular and must be vacated so the originating summons proceeds inter partes.
