The Court of Appeal allowed the appeal, holding that the High Court erred in exercising its civil jurisdiction to grant declaratory relief that effectively determined the merits of a pending criminal charge; such determinations are premature and must be left to the Magistrate's criminal trial and available CPC remedies; the prosecution had valid PP consent and the High Court should not have set aside the criminal charge via a civil OS.
