Defendant’s appearance and defence were struck out because the Defendant became aware of the proceedings on 27.10.2020 but provided no satisfactory explanation for the subsequent delay to file appearance; more importantly the Defendant’s pleadings amounted to approbation and reprobation—the statutory declaration that justified the consent judgment was later disavowed, rendering the consent judgment unsupported and the defence frivolous, vexatious and an abuse of process; therefore the strike out was justified and the application for extension of time was dismissed.
