The Form 14A used to effect the transfer bore a forged attestation/signature of the attesting officer (SP2) and was not attested by the Land Administrator as required for Malay Reserve land under s.211 and the Fifth Schedule; therefore the instrument was void or insufficient and the registration obtained is defeasible under s.340(2)(b) of the National Land Code. Consequently the transfer is set aside and the deceased restored as registered owner; no general or special damages awarded because plaintiff is not estate administrator.
