On balance of probabilities the Plaintiff failed to prove lack of approval; contemporaneous documents (Notice of Renovation with plans, Letter of Support, meeting minutes approving rooftop adoption, inspection and refund of deposit) and witness evidence established that the management or its authorized agents approved the works; Limitation did not bar the claim in the circumstances; accordingly the Plaintiff's claim is dismissed and the Defendant's counterclaim for declarations of approval succeeds.
