The Plaintiff's evidence (the 1973 letter, the long separation and non-cohabitation) was sufficient to shift the onus to the Defendant, who failed to produce evidence of any act of solemnization or sworn evidence proving a customary marriage prior to 1-3-1982; therefore the Defendant was not the deceased's spouse under the Distribution Act 1958 and must be removed as a beneficiary.
