On a balance of probabilities the Public Prosecutor proved that the seized bank account balances were proceeds of unlawful activity linked to the Grow Asia cheating scheme; AMLATFPUAA admissibility provisions (s71 and s40) permit use of investigation statements and documents including material originating from s112 CPC statements when obtained or relied upon under the AMLATFPUAA, and the Act does not require identification of each exact transaction in liquid accounts to order forfeiture.
