The High Court held that the Industrial Court had sufficient evidence to find the applicant breached the company's safety procedures by holding open-fire barbeques without prior approval; the applicant failed to plead or prove he had exclusive authority as OIM to approve such events; credibility-based factual findings of the Industrial Court are immune from judicial review absent lack of evidence or legal error; therefore the dismissal was with just cause and excuse and the judicial review application was dismissed.
