The court found the plaintiff's claim against Defendant First plainly unsustainable: it sought to re‑litigate and impugn prior committal proceedings already decided (and subject to appeal), plaintiff failed to specifically rebut Defendant First's affidavits or to cross‑examine on those allegations in the committal, the pleaded allegations were general and unsupported by particulars or evidence, and the claim therefore constituted a frivolous, vexatious and abusive use of process; accordingly the strike‑out application under Order 18 r19 succeeded.
