On the balance of probabilities the court found Defendants 3 (contractor), 4 (JKR) and 5 (State) liable for the tortious negligence in respect of the unsafe road hump and failing to ensure compliance with safety standards and warnings; JKR and the State were bound by statutory duty and vicarious liability principles and could not escape liability by relying on the contractor; apportionment of liability was 80% to Defendants 3,4 and 5 jointly and 20% to Defendant 1 (motorcar driver).
