The Court held that post-amendment Article 8(2) prohibits gender discrimination in law and that s.2(94) Eleventh Schedule permits reading 'father' in s.1(b) Part II Second Schedule to include 'mother' so as to harmonise citizenship provisions with Article 8(2); accordingly children born outside the Federation to Malaysian mothers married to non-citizen fathers acquire Malaysian citizenship by operation of law, and the High Court declaration in AOS 2356 stands; Appeal 273 allowed and Appeal 531 dismissed.
