The court found there were serious, bona fide disputes of fact as to river encroachment, its extent and the legal effect on title; accordingly the court ordered the State Director of Lands to request the Director of Survey and Mapping to conduct an official re-survey under ss353/382A (including assessment of high-water mark of ordinary spring tides), and directed that the disputed factual issues be tried viva voce after certified resurvey plans are produced; the court exercised its power to compel public officers to perform statutory duties to give effect to justice.
