Defendant failed to establish any bona fide triable issue: JLM's contemporaneous confirmation negated alleged permit breaches; fraud and conspiracy allegations were unpleaded until after the summary application and unsupported by documents; defendant had not objected to account statements or deliveries (giving rise to estoppel).
