The productivity allowance formed part of the Respondents' wages under the Employment Act; s24(1) prohibits deductions except as permitted by statute or by agreement; Clause 4.2 did not lawfully permit unilateral rescission of the productivity allowance; therefore the Labour Court correctly ordered payment and the unilateral reduction amounted to a repudiatory breach.
