The court set aside the arbitrator's award and the confirmatory judgment because (1) the arbitrator breached the consent order by not providing the award to the parties before the High Court confirmed it, thereby denying the applicant the statutory right under s24A(3)(b) CJA to seek setting aside and breaching audi alteram partem; (2) the High Court lacked jurisdiction to confirm the award suo moto absent express statutory authority; and (3) on the merits the award contained legal and factual errors regarding entitlement to additional extension of time, rendering termination wrongful.
