The court held that although an accused who pleads guilty may appeal, there was no illegality or prejudice in the summary proceedings because the plea was properly recorded under s173 CPC; prior convictions were validly proved by certified court records (s400 CPC) and harmonised with the registration statute; the sentence was within the mandatory s39C(1) Dangerous Drugs Act range and appropriately considered mitigation; therefore the conviction and sentence were lawful and the appeal was dismissed.
