Rosilah has no cause of action against the developer because she purchased at bank auction and no contractual relationship with the developer existed; the developer's representation that Taman Green Hill was a strata development was supported by Land Office approval and therefore not false; the agreement expressly disclaimed common facilities and plaintiffs failed to prove they were induced by any alleged representations (including gated status), hence the claim for misrepresentation fails and the plaintiffs' claim is dismissed with costs.
