Because a separate strata title had been issued and there was no registered statutory charge, the deed required the plaintiff to obtain transfer and register a statutory charge before the bank could lawfully enforce by public auction; the defendant's affidavits were rejected for procedural defects and there was no effective response to the plaintiff's allegations, therefore the court granted an interlocutory injunction restraining the defendant from selling the property by public auction and ordered costs in the cause.
