The court held plaintiffs have a reasonable and sustainable cause of action because (i) under binding authority the Controller lacked power to grant the impugned extension so plaintiffs' statutory claims are maintainable as civil claims, (ii) causes of action accrued upon delivery of vacant possession so limitation does not bar the claims filed within the applicable period, and (iii) estoppel/settlement/section 64 defences raise factual issues not suitable for summary disposal; accordingly the strike-out application failed and the Sessions Court decision was affirmed.
