Plaintiff failed to demonstrate special circumstances to justify a stay: the appeals had fixed hearing dates and the plaintiff's failure to comply with pre-trial directions meant no trial date was set; moreover the setting aside of the Judgment in Default destroyed the essential substratum of the Plaintiff's s540 claim and the Plaintiff's conduct evidenced an abuse of process; accordingly the stay was dismissed and the claim struck out as plainly unsustainable.
