Although jurisdiction under s23(1)(b) existed because the defendant resided in Malaysia, the court exercised its discretion under the doctrine of forum non conveniens and held that Singapore was the natural and more appropriate forum for a dispute arising wholly in Singapore with witnesses and documentary evidence located there; plaintiff failed to show Malaysia was appropriate and claim was struck out.
