The defence as pleaded was a mere, unparticularised denial and therefore frivolous and vexatious; material admissions in the defence and the defendants' conduct (agreement to settlement plan, payment of an instalment and stopping a later cheque) together with signed trade account and guarantee established liability and enforceability of the contractual interest clause, so the court struck out the defence and entered final judgment for the plaintiff with costs on the prescribed scale.
