The counterclaim was struck out because the Friendly Loan Agreement’s validity and the Appellant’s defences were conclusively determined by the summary judgment which was affirmed by the High Court and Court of Appeal, therefore the counterclaim sought to relitigate issues barred by res judicata and issue estoppel and amounted to an abuse of process and a scandalous, frivolous and vexatious pleading under Order 18 r 19 ROC.
