Section 13 and 13A of the BDRA 1957 apply to all persons including Muslims; the term 'surname' in section 13A includes patronymic names (the father's personal name) where paternity is acknowledged; state Islamic personal law cannot be imported to qualify or displace the federal BDRA; the Registrar acted outside the powers of the BDRA in ascribing 'bin Abdullah' and the appropriate remedy is correction of the birth register to reflect the father's name (bin MEMK).
