The high court order granting letters of administration dated 13.7.2015 vested in the plaintiff representative capacity and the right to sue for causes of action that survived the deceased; extraction of the grant is a procedural completion and does not defeat locus standi; therefore the sessions court rightly refused to strike out the suit and rightly allowed amendment to reflect administrator capacity.

The amendment to name Pushparani as personal representative was misconceived because the deceased had died before the suit was commenced; O 15 r.6A does not authorize commencement of a suit on behalf of an estate where no grant has been obtained and the rules relied on (O 15 r.6A/7/8) were inapplicable; absent letters of administration or probate the plaintiff lacked locus to sue and the action was therefore unsustainable and struck out.

Because the defendant had died before the commencement of the suit and the plaintiff failed to take the mandatory steps required by Order 15 Rule 6A(4) to substitute or appoint a representative for the estate, the proceedings were fatally defective; non-compliance rendered the trial and judgment null and void and estoppel did not relieve the plaintiff of the obligation to correct the adjectival defendant.
