The High Court held that the prolonged suspension of over 2 years 5 months without timely disciplinary proceedings constituted an abuse of process and breached mandatory requirements of Regulation 29 PPPA 1993; furthermore the dismissal was disproportionate to the minor drug offence. Consequently the disciplinary board's decision to dismiss was quashed, reinstatement ordered with arrears and costs, with execution stayed pending appeal.
