The High Court held the Tribunal was correct: the operative act was suspension not substantive termination; under UUK 31(2) abstentions are to be counted as not supporting the motion, which meant the requisite majority for termination was not obtained; inconsistent terminology in the Award was mere surplusage and did not invalidate the Award; accordingly the appeal is dismissed.
