The Court held the learned Judicial Commissioner correctly applied O.18 r.19: the plaintiffs' claims were barred by res judicata and issue estoppel because identical issues had been finally determined in earlier proceedings (Magistrate Court and High Court) and the plaintiffs' own correspondence admitted termination. The pleaded allegations of fraud and forgery were found to be afterthoughts and plainly unsustainable; therefore striking out was appropriate. Appeals dismissed and costs awarded.
